Micro-Captive Insurance Companies
Although Micro-Captive Insurance Companies are first and foremost a risk management tool, IRS code section 831(b) allows operating companies to utilize Micro-Captives to convert uninsured risks into income tax deductions and reduce estate taxes. Premiums on uninsured risks are paid from an operating company to a Micro-Captive; they are deductible to the operating company and received by the Micro- Captive tax free.
Upon the liquidation of the Micro-Captive, distributions are taxed at long term capital gains rates. The premiums are actuarially supported and the Micro-Captive can be owned by the owners or employees of the operating company or a trust for children and grandchildren. Current P & C insurance coverage by third party carriers is normally not changed
